Who is responsible when a motorist chooses to read or respond to a text message he receives while driving, distracting him at a critical moment and resulting in an automobile accident? In terms of criminal culpability, the answer may be obvious: the driver who chose to text on the road is responsible for his own dangerous behavior. However, a recent ruling by a New Jersey Appellate Division panel has expanded the reach of civil liability to include a person who texts a driver and creates a situation in which that driver is likely to engage in distracted driving behaviors. This means that, in the event of a crash, the injured parties may sue not only the driver for damages, but under some circumstances, the sender of text messages to the driver as well.
