During the "discovery" phase of any personal injury lawsuit, it is generally expected that the plaintiff, or claimant, will undergo a medical evaluation by an "independent" medical expert. This report is intended to serve as the basis for the claimant's settlement negotiations with the insurance company, and will be submitted as evidence and that doctor will be an expert witness should the case go all the way to trial. In an ideal world, these medical examinations would be conducted by an honest doctor with no agenda other than accurately determining the severity and scope of the plaintiff's injuries. Unfortunately, when dealing with medical experts hired by insurance companies, this ideal is rarely met, if ever. The insurance industry and their attorneys like to call such an exam an "IME"- independent medical exam- but I call it a "DME"- a defense medical exam, because it is anything but independent.

My client, Jennifer, left for work as a massage therapist on January 8, 2010 — but a slip on black ice in the Mall parking lot where she worked left her unable to work as a massage therapist again.

On January 8, 2010, Jennifer drove to the Mall where she was employed at Massage Envy. While walking from her car to the front door, she had to step over a snow bank left by the snowplowing contractor, and Mall maintenance manager, George S. Hall, Inc. Although she used care in where she stepped, her left foot slipped on black ice. There was no ice melting material in the area. Although Jennifer did not fall to the ground, she twisted her left knee sufficiently that she needed a co-worker to drive her to the hospital emergency room.

OK, we’ve covered Uninsured Motorist coverage and Underinsured Motorist coverage– the “UM/UIM Coverage” in your policy. (If you have not read them, let me know and I’ll get those installments to you.)

Today let’s talk about PIP. It stands for Personal Injury Protection. Why do they call it that? To hide and confuse, that’s why (in my opinion). It’s really medical expense coverage — like your medical insurance (if you have it) or Medicare (if you’re eligible).  The problem is, these days most of my clients don’t have medical (health) insurance  and they are not eligible for Medicare. $467,000 Settlement for NJ Chronic Pain Injury from Movie Theater
