Car Accidents in New Jersey

Car Accident Lawyer Serving Morristown and All of Northern and Western New Jersey

If your life was thrown off course by a car accident caused by the negligence of another, you deserve compensation. Unfortunately, insurance companies are complicated business organizations. Like most businesses, their main focus is on their own bottom line. It can be very difficult to secure adequate compensation without the help of a lawyer.

I'm attorney Francis M. Smith, and I have practiced personal injury law for over 30 years. I work to efficiently negotiate settlements that truly compensate my injured clients. For a free consultation, call 908-233-5800 or contact my office online. I represent clients throughout northern and western New Jersey, including those in Sussex County, Union County, Morris County and Hunterdon County.

At my law firm, I handle injury cases of all kinds, as well as all kinds of accidents that can occur on the roadway. Follow the links below to find out more about your auto accident:

What's the "Limitation on Lawsuit Threshold?"

When you bought your insurance policy, you may have opted for a less expensive option that came with a "limitation on lawsuit threshold." Up to 90 percent of all New Jersey auto insurance policies have this threshold. It limits the circumstances under which you can claim non-economic (“pain and suffering”) damages when you are injured in an auto accident.

The threshold only applies to "car-to-car" accidents (it's different when a commercial vehicle, like a truck, is involved.) in which the policyholder was not at fault, and where the driver at fault was uninsured or underinsured. In some of these cases, the policyholder is forced to collect from his or her own uninsured/underinsured motorist coverage, or those of a family member. Even attorneys who do not regularly handle such cases find the law and rules confusing.

The limitation on lawsuit threshold may make it difficult to recover a fully adequate amount of compensation. If you have questions about whether or not your policy prevents you from claiming compensation for your injuries, you owe it to yourself to talk to a lawyer.

At The Law Office of Francis M. Smith, Esq., I offer free consultations, so there is never any risk for anyone who only needs a few questions answered. This decision could affect you for the rest of your life. It certainly affects whether you can make a claim.

For your free consultation, call 908-233-5800 or contact my office online today. Many clients, when they first come to me, don’t know if they have a viable claim. That’s O.K. Becoming a client is virtually risk-free, because there is never a fee if I can’t obtain a compensation for you from the insurance carrier for the person who caused your injury.

I know that many injured people are now without a vehicle, or the ability to drive. A prescription drug may prevent you from driving. I have a reputation for responding to clients who need me, wherever in New Jersey they are. Call me about your case and I will meet with you wherever it is necessary.
