Commercial Vehicle & Delivery Truck Accidents

Recovering Compensation for Those Injured in New Jersey Commercial and Delivery Truck Accidents

There are countless commercial vehicles and delivery trucks on the road each day. In most cases, trucks are in good condition and the drivers are following trucking regulations and the rules of the road. However, these things don't always happen and the results can be devastating.

If you were seriously injured in a commercial or delivery truck accident, you deserve compensation to cover your medical expenses, lost wages, pain and suffering, and other losses.

I'm attorney Francis M. Smith, and I have practiced personal injury law for over 3 decades. I work to efficiently negotiate settlements that truly compensate my injured clients. For a free consultation, call 908-264-2017 or send me an e-mail.

A Personal Approach to Your Accident Injury Case

At my office, the client's satisfaction with the process and the results is everything to me. I take great pride in offering personalized service to all of my clients. They know that they can trust me to regularly update them on the status of their case and to quickly respond to their questions. They also trust my experience — I have handled personal injury accident cases for more than 30 years.

Finally, they trust that I won't overburden them financially. I do not charge attorney fees unless I recover settlements for my clients.

Causes of Commercial Vehicle and Delivery Truck Accidents

Many truck accidents are the direct result of either the truck driver or trucking company violating the Federal Motor Carrier Safety Regulations (FMCSRs). These complex regulations are meant to prevent truck accidents and protect innocent motorists. Unfortunately, the FMCSRs are often violated, resulting in serious and even fatal injuries.

Commercial vehicle and delivery truck accidents can often be attributed to the following causes:

  • Improper inspection or inadequate maintenance
  • Extended hours — Drivers working extended or odd hours, causing driver fatigue
  • Delivery schedules — Drivers must often meet tight schedules or are given incentives to work faster and without rest, thereby increasing their chances of an accident
  • Improperly secured loads
  • Heavy loads — Commercial vehicles and delivery trucks may carry loads that are heavier than the FMCSRs allow (over the weight limits)
  • Driving under the influence of alcohol or drugs
  • Inadequate training or hiring

Accidents also occur when trucks must use multiple lanes for turning or jackknife from improper braking or turning.

Recovery for Your Injuries

If the commercial vehicle or delivery truck driver, or trucking company was negligent (they did not use reasonable care to avoid your injury), you can recover for your injuries. However, there may be more than one party at-fault. Through police reports, witness testimony and, if necessary, accident reconstruction, I will determine what caused your injury and who should pay for it.

I will then negotiate for a comprehensive personal injury settlement, including compensation for your physical, financial and emotional injuries.
