What's the "Limitation on Lawsuit Threshold"?

When you bought your insurance policy, you may have opted for a less expensive option that came with a "limitation on lawsuit threshold." Up to 90 percent of all New Jersey auto insurance policies have this threshold. It limits the circumstances under which you can claim non-economic (“pain and suffering”) damages when you are injured in an auto accident. The threshold only applies to "car-to-car" accidents (it's different when a commercial vehicle, like a truck, is involved.) in which the policyholder was not at fault, and where the driver at fault was uninsured or underinsured. In some of these cases, the policyholder is forced to collect from his or her own uninsured/underinsured motorist coverage, or those of a family member. Even attorneys who do not regularly handle such cases find the law and rules confusing.
